1. The Service
Daobreaker (“the Service”) is a text-based xianxia cultivation roleplay game powered by AI-generated narrative. By creating an account or otherwise accessing the Service, you agree to these Terms.
2. Eligibility
You must be at least 13 years old to use the Service. You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase a paid subscription. The Service contains depictions of violence, death, and dark themes inherent to the xianxia genre and is not intended for young children.
3. Accounts
You may play anonymously with a limited turn allotment, or bind an email to your account for the full free tier. You are responsible for any activity that occurs under your account. We may suspend or terminate accounts that abuse the Service, attempt to circumvent quotas, scrape content, or engage in unlawful activity.
4. Subscriptions and Billing
Paid subscriptions are billed monthly through Stripe. Current tiers and turn allotments are listed in the Service. Subscriptions auto-renew until cancelled.
- You may cancel at any time. Cancellation takes effect at the end of the current billing period; you retain access through that date.
- Turns consumed within a billing period are non-refundable. Unused turns do not roll over.
- We do not offer pro-rated refunds for partial months. If you believe you were billed in error, contact us.
- Prices may change with at least 30 days’ notice. Changes apply to your next billing cycle.
5. AI-Generated Content
All narrative, images, and dialogue produced by the Service are generated by third-party AI models in response to your inputs and game state. AI output:
- May contain inaccuracies, inconsistencies, or content you find unexpected or objectionable.
- Is not factual advice — medical, legal, financial, or otherwise.
- Is influenced by your own actions and prompts. You are responsible for the inputs you provide.
We make no warranty that AI output will be accurate, suitable, or non-offensive. If you encounter content that violates the Service’s rules or applicable law, please report it.
6. Acceptable Use
You agree not to:
- Use the Service to generate content depicting minors in sexual contexts, real-person harassment, or content that violates applicable law.
- Reverse-engineer, scrape, or attempt to extract training data from the Service.
- Attempt to bypass turn limits, billing, or rate limits, or use automation to play on your behalf.
- Resell, redistribute, or expose the Service’s API to third parties without written permission.
7. Your Content
You retain ownership of the character names, prompts, and creative direction you contribute. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and transmit that content as needed to operate the Service (including sending it to AI providers for processing). We do not sell your content or use it to train models.
AI-generated output produced through the Service is provided to you for personal use. Ownership of AI output varies by jurisdiction; we make no claim over the specific narrative your character creates.
8. Our Intellectual Property
The Service, including its name, logo, mechanics, code, prompts, and branding, is owned by us. These Terms grant you a limited, revocable license to use the Service for personal entertainment. They do not grant you any right to our trademarks or codebase.
9. Termination
You may delete your account at any time by contacting us. We may suspend or terminate your account for violation of these Terms, fraudulent payment activity, or extended inactivity. Upon termination, your save data may be deleted. Paid subscriptions are not refunded on termination for cause.
10. Disclaimer of Warranties
The Service is provided “as is” without warranty of any kind. We do not guarantee uninterrupted availability, error-free operation, or that any specific feature will continue to exist. AI providers, payment processors, and infrastructure providers we depend on may experience outages outside our control.
11. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of the Service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost progress, lost save data, or emotional distress arising from in-game events.
12. Changes to These Terms
We may update these Terms. Material changes will be announced in-game or via email at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.
13. Governing Law and Disputes
These Terms are governed by the laws of the United States. Any dispute that cannot be resolved informally will be resolved by binding arbitration on an individual basis. You waive the right to participate in class actions to the extent permitted by law.
